In the science of criminal procedure, three main forms of bringing to trial are usually distinguished: bringing to trial by the prosecutor, bringing to trial by the court, and the combination of two. At the same time, at the present stage of the evolution of criminal proceedings, there is an increasing interpenetration of various judicial systems, which makes it difficult to correlate the procedure of bringing to trial in the criminal process of a particular country and the theoretical features inherent in the forms of bringing to trial procedure by the prosecutor and the court. This article analyzes the model of bringing to trial in Russia, examines the ways of differentiation of bringing to trial procedure depending on the peculiarities of the development of dispositive principles in the criminal process of certain foreign countries and examines the possibility of applying the considered experience of foreign countries that allow the mixing of various forms of bringing to trial, in order to solve some problems of bringing to trial procedure in the criminal process of Russia, the conclusion is made about the possibility of the development of dispositive principles in the criminal process of Russia by introducing differentiation of bringing to trial procedure depending on the will of the victim.
