The article undertakes a historical and legal analysis of the protection of the labor rights of women and children in the second half of the XIX - early XX centuries. It is noted that the judicial protection of the labor rights of pregnant women, mothers, and minor children was of paramount importance, since it allowed to mitigate the imperfections of pre-revolutionary legislation. This was due to the fact that when resolving specific cases, the courts had the opportunity to interpret the law, taking the side of the least protected subjects of law: women and children. Factory inspectors, faced with violations of working conditions on the ground, had administrative powers to bring the perpetrators to justice. In addition, social welfare agencies in the field of maternity and childhood protection provided assistance to women and children who found themselves in a difficult life situation. The novelty of the work lies in a comprehensive analysis of the protection of the labor rights of women and children in Russia in the second half of the XIX – early XX centuries. The purpose of the work: to form a scientific understanding of the role of protecting the labor rights of women and children in Russia in the second half of the XIX – early XX centuries. judicial authorities, factory inspectors, social welfare agencies. When writing the work, the author actively used the historical-comparative method, formal-logical methods (analysis, synthesis).
