В статье предпринят историко-правовой анализ защиты трудовых прав женщин и детей во второй половине XIX – начале ХХ вв. Отмечается, что судебная защита трудовых прав беременных женщин, женщин-матерей, несовершеннолетних детей имела первостепенное значение, поскольку позволяла смягчить несовершенства дореволюционного законодательства. Указанное обуславливалось тем, что при разрешении конкретных дел суды имели возможность толковать право, вставая на сторону наименее защищенных субъектов права: женщин и детей. Фабричные инспектора, сталкиваясь на местах с нарушением условий труда, имели административные полномочия для привлечения виновных к ответственности. Кроме того, органы социального призрения в области охраны материнства и детства оказывали помощь женщинам и детям, оказавшимся в сложной жизненной ситуации. Новизна работы заключается в комплексном анализе защиты трудовых прав женщин и детей в России во второй половине XIX – начале ХХ вв. Цель работы: сформировать научное представление о роли защиты трудовых прав женщин и детей в России во второй половине XIX – начале ХХ вв. судебными органами, фабричными инспекторами, органами социального призрения. При написании работы автором был активно использован историко-сравнительный метод, формально-логические методы (анализ, синтез).
The article undertakes a historical and legal analysis of the protection of the labor rights of women and children in the second half of the XIX - early XX centuries. It is noted that the judicial protection of the labor rights of pregnant women, mothers, and minor children was of paramount importance, since it allowed to mitigate the imperfections of pre-revolutionary legislation. This was due to the fact that when resolving specific cases, the courts had the opportunity to interpret the law, taking the side of the least protected subjects of law: women and children. Factory inspectors, faced with violations of working conditions on the ground, had administrative powers to bring the perpetrators to justice. In addition, social welfare agencies in the field of maternity and childhood protection provided assistance to women and children who found themselves in a difficult life situation. The novelty of the work lies in a comprehensive analysis of the protection of the labor rights of women and children in Russia in the second half of the XIX – early XX centuries.
