Abstract (English):
V usloviyah formirovaniya edinogo pravovogo prostranstva dlya svobodnogo peredvizheniya trudovyh resursov mezhdu gosudarstvami Evraziyskogo ekonomicheskogo soyuza (EAES) vysokuyu aktual'nost' priobretayut voprosy pravovogo regulirovaniya rastorzheniya trudovogo dogovora po iniciative rabotodatelya. Cel' raboty — provesti sravnitel'no-pravovoe issledovanie zakonodatel'stva gosudarstv EAES po voprosam, svyazannym s uvol'neniyami po iniciative rabotodatelya, na predmet nalichiya probelov, kolliziy i sootvetstviya mezhdunarodnym trudovym standartam. Dlya etogo avtorom proveden analiz sootvetstvuyuschih mezhdunarodnyh standartov i zakonodatel'nyh norm. V issledovanii ispol'zovany sravnitel'no-pravovoy i formal'no-yuridicheskiy metody, proanalizirovany osnovaniya i poryadok prekrascheniya trudovyh otnosheniy po iniciative rabotodatelya, osnovannyy na chetyreh klyuchevyh kriteriyah: uvedomleniya, vyhodnye posobiya, zaprety (ogranicheniya) i osobye usloviya (garantii). Vse osnovaniya uvol'neniy rassmatrivalis' v ramkah chetyreh klassifikacionnyh kategoriy: ekonomicheskie, mediko-kvalifikacionnye, disciplinarnye i special'nye (harakternye dlya otdel'nyh kategoriy rabotnikov). V rezul'tate issledovaniya vyyavleno, chto nekotorye podhody k zakonodatel'nomu regulirovaniyu prekrascheniya trudovyh otnosheniy razlichayutsya mezhdu soboy, a takzhe ne v polnoy mere sootvetstvuyut mezhdunarodnym trudovym standartam. V chastnosti, eto kasaetsya nedopustimyh osnovaniy uvol'neniy rabotnikov i nesootvetstviya ustanovlennyh im garantiy konvenciyam i rekomendaciyam Mezhdunarodnoy organizacii truda (MOT). Vyyavleny yavnye narusheniya mezhdunarodnyh obyazatel'stv v ramkah MOT, svyazannye s vozrastnoy diskriminaciey i zakonodatel'nym zakrepleniem vozmozhnosti uvol'nyat' lic, prizvannyh na voennuyu sluzhbu. Avtor prihodit k vyvodu, chto dlya formirovaniya evraziyskogo rynka truda trebuetsya garmonizaciya trudovogo zakonodatel'stva stran EAES v chasti uvol'neniy rabotnikov v sootvetstvii s minimal'nymi trudovymi standartami. Sformulirovany rekomendacii po sovershenstvovaniyu zakonodatel'noy osnovy rastorzheniya trudovogo dogovora po iniciative rabotodatelya.
