First aid to injure of accidents at work takes the significant place in the system of labor protection as an important element of preserving life and safety of workers who are injured or have experienced a sharp deterioration in health during working hours. Nevertheless, the legal component of first aid has not yet been worked out in detail. As shown in the article, the main problem is that first aid treatment to injure at work is not limited to labor legislation, but is also an important part of the legislation on the protection of public health, criminal law. The article offers a comprehensive, systematic look at the legal aspects of first aid treatment at work with a focus on the need for an explicit separate determination and enforcement of the legal process "empower" and "bind" in organization of the first aid treatment at the employer.

1. Введение
Оказание первой помощи пострадавшим выступает одним из элементов системы сохранения жизни работников в процессе трудовой деятельности. Своевременное и правильное оказание помощи работнику, получившему травму или почувствовавшему недомогание, может сохранить здоровье и жизнь работнику, как и средства индивидуальной или коллективной защиты, обучение безопасным методам работы или страхование. Трудовое законодательство отмечает необходимость наличия в системе управления охраной труда такого мероприятия, как «обучение оказанию первой помощи пострадавшим на производстве», требует от работодателя (ст. 225 ТК РФ [2]) обучения абсолютно всех работников оказанию первой помощи, но не определяет важные моменты, необходимые для правильной (с точки зрения законодательства) организации такого обучения.
Еще более сложный и важный вопрос, чем организация обучения оказанию первой помощи пострадавшим на производстве, организация собственно оказания такой помощи. Известно, что уровни подготовки «иметь представление», «знать», «уметь», «иметь навык» существенно отличаются по их соответствию практическим потребностям. В вопросах оказания первой помощи пострадавшим только уровень «иметь навык» соответствует понятию «быть компетентным1».
