В статье рассматриваются мнения и позиции американских специалистов в области международного права и международных отношений, посвященные весьма неоднозначной концепции «справедливой войны». Данная концепция вызывает массу вопросов относительно ее соответствия действующему международному праву, особенно в контексте принципа неприменения силы и угрозы силой, закрепленного в Уставе Организации Объединенных Наций. Предметом исследования стали труды американских юристов-международников по вопросу содержательного наполнения и правовых аспектов названной концепции. Отсылка к концепции «справедливой войны» часто звучит в речах американских политических деятелей, оказывая значительное влияние на внешнеполитическую стратегию США. Таким образом, необходима правовая оценка концепции «справедливой войны» в контексте действующего международно-правового поля. В отечественной доктрине международного права данная концепция практически не освещалась, и предлагаемая статья призвана заполнить этот пробел.
