In the article the most actual problems connected with restriction of competences of the owner of premises on possession, use and order are considered. The author comes to the conclusion that ownership limitations on premises can have not only lawful, but also contractual character. In the article cases of restriction of competences of possession, use and order of the owner of premises are analyzed. Shortcomings of the existing civil and housing legislation of the considered area are revealed and offers on its improvement are formulated.
