The article is devoted to the study of the history of the formation of the institute of suspension of preliminary investigation in the context of protecting the rights of participants in criminal proceedings, especially in the context of a special military operation. The focus is on changes in both legislative norms and law enforcement practice, which were caused by current social challenges. The author analyzes the procedural decision related to paragraph 3.1 of Part 1 of Article 208 of the Criminal Procedure Code of the Russian Federation (hereinafter referred to as the CPC RF), emphasizing the need to ensure the rights of participants in criminal proceedings. In the context of the article, the key element is the discussion of how current changes in legislation reflect the needs of the time and what human rights mechanisms can be introduced to improve the protection of the rights of participants. The author emphasizes that the existing law enforcement practice requires further analysis and improvement in order to more accurately meet the changing conditions and requirements of justice. The main idea of the article is that despite the measures already taken, the legislation and law enforcement practice of the Russian Federation need additional adjustment and development to ensure effective and fair implementation of the suspension of the investigation, especially in a complex and unstable social environment. This emphasizes the importance of constant monitoring and adaptation of legal norms to modern requirements in order to ensure the rights of participants in criminal proceedings.
