The article is devoted to the financial and legal analysis of certain properties of the legal regime of the state contract system from the perspective of budgetary financing of state bodies and state-owned institutions. The specifics of participation in the state contract system of bodies and state-owned institutions of the penal system of the Russian Federation are taken into account. The author substantiates that the state contract system is combined with financial and legal instruments for ensuring state needs, manifested in the activities of bodies and institutions. The participation of bodies and institutions of the penal enforcement system in the state contract system is the basis for applying the financial and legal regime of budget expenditures, the budget process, and budget planning to the relevant departmental entities. At the same time, the conclusion of government contracts is a business–oriented engine of trade, involving government agencies and institutions in property relations, which traditionally have civil law features.
