В соответствии с Бюджетным кодексом Российской Федерации одним из источников финансирования дефицита бюджета являются государственные (муниципальные) заимствования. В связи с тем, что перед бюджетами в России стоит задача обеспечения экономического роста опережающими темпами, актуальность приобретают государственные ценные бумаги (как инструмент привлечения временно свободных денежных средств физических и юридических лиц), рынок ценных бумаг (как феномен – часть финансового рынка – на котором происходит выпуск соответствующих ценных бумаг и оборот выпущенных ценных бумаг), а также организация рынка ценных бумаг (как институт финансового права, нормы которого регулируют соответствующие общественные отношения, связанные с правилами выпуска, размещением и обращением и обращением ценных бумаг). Необходимо отметить, что такие правовые явления как рынок ценных бумаг и организация рынка ценных бумаг актуальны не только в связи реализацией полномочий в сфере бюджетной политики публично-правовыми образования. На сегодняшний день интерес к ним испытывают и частные субъекты: как инвесторы (с целью заработка на вложении денежных средств в ценные бумаги) и как субъекты, привлекающие инвестиции (предприятия выпускающие акции или облигации для привлечения ликвидности с целью расширенного воспроизводства). В статье синтезированы понятия рынка ценных бумаг, организации рынка ценных бумаг, что способно положительно повлиять на правовое регулирование в указанной сфере.
In accordance with the Budget Code of the Russian Federation, one of the sources of financing the budget deficit is state (municipal) borrowing. Due to the fact that the budgets of the budgetary system in Russia face the task of ensuring economic growth at a faster pace, government securities are becoming relevant (as a tool for attracting temporarily free funds from individuals and legal entities), the securities market (as a phenomenon – part of the financial market – in which the issue of relevant securities and the turnover of issued securities securities), as well as the organization of the securities market (as an institution of financial law, the norms of which regulate the relevant public relations related to the rules of issuance, placement and circulation and circulation of securities). It should be noted that such legal phenomena as the securities market and the organization of the securities market are relevant not only in connection with the implementation of powers in the field of budgetary policy by public legal entities. To date, private entities are also interested in them: as investors (for the purpose of earning money by investing in securities) and as entities attracting investments (enterprises issuing shares or bonds to attract liquidity for the purpose of expanded reproduction). The article synthesizes the concepts of the securities market, the organization of the securities market, which can have a positive impact on legal regulation in this area.
