THE PROBLEM OF UNDERSTANDING THE LAW AND INTERPRETATION OF LEGAL TEXTS: PHILOSOPHICAL AND LEGAL ASPECT

Abstract (English):
The authors address the study of the problem of the relationship between legal understanding and interpretation of legal texts. Attention is focused on the influence of the paradigm of scientific thinking, which determines the process and result of legal understanding, defines the uniformity of the semantic field in which the interpretation is carried out, and sets the methodological parameters for the search for legal truth. It is emphasized that within the framework of non-classical discourses, the interpretation of legal texts is defined as part of the process of legal understanding, which is characterized by such immanent features as purposefulness and interpretativity, reflection of the spatio-temporal section of legal culture. The authors come to conclusions about the special significance in the Russian legal space of the formation of a unified legal ideology based on traditional values, as a guarantor of the uniformity of the interpretation of legal texts and a factor in the formation of a high level of legal culture in Russian society.
