В статье анализируется влияние религиозных норм на брачно-семейное право в середине XIX – начале ХХ вв. в России. Авторами исследовано российское семейное законодательство указанного периода с точки зрения подверженности религиозному влиянию на регулирование отношений между супругами, между родителями и детьми, а также опекунами и подопечными. Новизна работы заключается в том, что правовые нормы, регулирующие брачно-семейные отношения в середине XIX – начале ХХ вв., проанализированы в контексте религиозных представлений о семье. В настоящее время в ст. 67.1 Конституции Российской Федерации закреплено, что Российская Федерация, объединенная тысячелетней историей, сохраняет память предков, передавших нам идеалы и веру в Бога. В этой связи обращение к религиозным основам брачно-семейного законодательства представляет особый интерес. Цель работы: проанализировать влияние религиозных норм на брачно-семейное право в России в середине XIX – начале ХХ вв. При написании работы авторами был активно использован сравнительно-правовой метод, а также исторический метод.
The article analyzes the influence of religious norms on marriage and family law in the mid-XIX – early XX centuries. in Russia. The authors investigated the Russian family legislation of the specified period from the point of view of exposure to religious influence on the regulation of relations between spouses, between parents and children, as well as guardians and wards. The novelty of the work lies in the fact that the legal norms regulating marriage and family relations in the mid-XIX – early XX centuries are analyzed in the context of religious ideas about the family. Currently, Article 67.1 of the Constitution of the Russian Federation stipulates that the Russian Federation, united by a thousand-year history, preserves the memory of ancestors who passed on to us ideals and faith in God. In this regard, the appeal to the religious foundations of marriage and family legislation is of particular interest. The purpose of the work is to analyze the influence of religious norms on marriage and family law in Russia in the mid-XIX – early XX centuries. When writing the work, the authors actively used the comparative legal method, as well as the historical method.
