The basis of the relationship and distinction between administrative and criminal law is the concept of criminalization and decriminalization of an act, which over time has led to the emergence of the phenomenon of administrative prejudice, acting as an interdisciplinary legal institution. The diversity of social relations, which are in a state of continuous transformation, necessitates the improvement of the criminal law, using various legal means. The study of this phenomenon is of particular importance in order to understand its benefits to society and the expediency of having an administrative prejudice in the modern Russian legal field. Our goal is to study this institution using the example of petty theft and theft, respectively, as one of the most frequently committed crimes included in the list of the Administrative Code of the Russian Federation and the Criminal Code of the Russian Federation.
