INVOLVEMENT OF MINORS IN THE COMMISSION OF CRIMES, OTHER ILLEGAL OR ANTISOCIAL ACTS AS A CONSTITUTIVE CRIMINAL LAW CATEGORY

Abstract (English):
The article considers involvement as a constitutive criminal law category that plays a key role in the system of protection of the rights and legitimate interests of minors. Its purpose is to develop a theoretically sound and legally accurate understanding of the category of "involvement" in relation to minors, as well as to clarify its criminal-legal nature, features, scope and differences from related concepts (declension, incitement, recruitment), taking into account legislative structure, scientific doctrine and judicial practice. The author identifies three approaches to the regulation of the term "engagement" in the text of the Criminal Code of the Russian Federation, and conducts a semantic, doctrinal, and practice-oriented analysis of its essence. Special attention is paid to the issue of the ratio of "engagement" and "declension", the moment of their termination. The conclusion identifies the main signs of involvement and formulates the author's concept of involving minors in the commission of a crime, other illegal or antisocial actions.
